These Terms of Use ("Terms") govern your access to and use of The AI Observer, including our website, podcasts, videos, articles, newsletters, memberships, comments and any related services (together, "The AI Observer"). By using The AI Observer, you agree to these Terms. If you do not agree, please do not use it.
1. Who we are
The AI Observer is operated by Percy Real Estate Ltd, trading as The AI Observer, a company registered in England and Wales under company number 15525233, with its registered office at 25 Cabot Square, London, England, E14 4QZ ("we", "us", "our"). The AI Observer is a publication of Matchouse.
You can contact us at [email protected]. Legal notices should be sent to [email protected].
2. What we provide
The AI Observer is a digital media platform about artificial intelligence, emerging technology and their impact on people, work and business. We publish podcasts, video, articles, blogs, interviews and newsletters, and we work with technology companies on clearly labelled sponsored content and marketing collaborations.
We may change, add or remove content, features, formats or membership benefits at any time. We aim to keep The AI Observer available, but we do not guarantee that it will always be available, uninterrupted or error-free.
3. Who can use The AI Observer
You may browse our public content without an account. To create a free or paid membership, comment, or subscribe to our newsletter, you must be at least 16 years old, or the minimum age required in your country to consent to the processing of your personal data, and able to enter into a binding agreement.
4. Information, not professional advice
Our content is published for general information, education and discussion. It does not constitute financial, investment, legal, technical, medical, security or other professional advice, and you should not rely on it as such. Technology changes quickly, and while we work to be accurate, content may become out of date or contain errors.
Views expressed by hosts, guests, contributors and commenters are their own and do not necessarily reflect ours. Mentions of products, tools or companies are not endorsements unless we say so.
5. Memberships and accounts
Memberships are managed through our publishing platform, Ghost. Sign-in uses a secure link sent to your email address. You are responsible for keeping access to your email account secure and for activity that takes place through your membership. Please tell us promptly if you believe your membership has been used without your permission.
You must give accurate information and keep your email address up to date. You can update your details, manage newsletters or delete your membership at any time from your account page or by contacting us.
6. Paid memberships
Pricing and billing. Paid memberships are billed in advance, monthly or yearly, at the price shown when you subscribe. Payments are processed by Stripe; we do not store your full card details. Prices include any applicable taxes unless stated otherwise.
Renewal. Paid memberships renew automatically at the end of each billing period until cancelled. We will tell you in advance about any price change, and the new price will apply from your next renewal after the notice period. If you do not agree, you can cancel before the change takes effect.
Cancelling. You can cancel at any time from your account page. Your paid benefits continue until the end of the period you have already paid for, and you will not be charged again.
Your cancellation rights. If you are a consumer in the UK or EU, you have a legal right to cancel a new paid membership within 14 days of purchase. Because membership gives you immediate access to digital content, by subscribing you ask us to start providing it straight away and acknowledge that, once you begin accessing paid content, your right to cancel and receive a refund may be lost or the refund reduced to reflect what you have used, as permitted by law. This does not affect your other statutory rights.
Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods. If you think you have been charged in error, contact us at [email protected].
Donations. One-time contributions, where offered, are voluntary, do not purchase any goods or services, and are non-refundable except where required by law.
7. Newsletters
If you subscribe to a newsletter, we will email you new content and updates. Every email includes a link to unsubscribe or manage your preferences, and you can change your choices at any time from your account page.
8. Comments and contributions
Members may be able to comment on content. You are responsible for anything you post. You must not post content that:
- is unlawful, defamatory, harassing, hateful, threatening, discriminatory or obscene;
- infringes anyone else's intellectual property, privacy or other rights;
- impersonates any person or misrepresents your affiliation;
- contains spam, unsolicited advertising, malware or misleading links;
- shares anyone's personal information without permission; or
- is off-topic in a way that disrupts the conversation.
You keep ownership of what you post. You grant us a worldwide, non-exclusive, royalty-free licence to host, display, reproduce and moderate your comments in connection with The AI Observer. We may remove content, or suspend or end memberships, that break these Terms. We are not obliged to monitor comments, but you can report anything concerning to [email protected].
9. Sponsored content and editorial independence
We work with technology companies on sponsored articles, brand features, podcast and video collaborations, content marketing and partnerships. Paid content is always clearly labelled as "Sponsored" or otherwise identified as a paid collaboration. Our independent editorial content is kept separate from our commercial work, and sponsors do not control our independent coverage.
Commercial collaborations are governed by a separate written agreement between us and the client, which takes priority over these Terms for that work.
10. Our content and intellectual property
The AI Observer, including its name, logo, design, podcasts, videos, articles, graphics, transcripts and other materials, is owned by or licensed to Percy Real Estate Ltd and protected by intellectual property laws.
You may view, listen to, watch and share links to our content for personal, non-commercial use, and quote short extracts with clear attribution and a link to the source. You must not copy, republish, sell, redistribute, scrape, or create derivative works from our content, remove copyright notices, or use our content to train artificial intelligence or machine-learning models, without our prior written permission. Members-only content must not be shared with people who do not have access.
Guests and contributors who appear in or contribute to our content do so under separate release or contributor terms.
11. Acceptable use
You must not misuse The AI Observer. In particular, you must not attempt to gain unauthorised access to it or its systems; interfere with its security or operation; introduce malicious code; use automated means to access, copy or collect content except as permitted by our robots.txt; or use it in any way that is unlawful or harmful.
12. Third-party services and links
Our content may include links to, or embedded players from, third-party services such as YouTube, Spotify, Apple Podcasts and Vimeo. Those services are provided by third parties under their own terms and privacy policies, and we are not responsible for them. Links to other websites are provided for convenience and are not endorsements.
13. Our liability to you
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, for business losses, or for losses caused by your reliance on content provided for general information.
Subject to the above, our total liability to you in connection with The AI Observer is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) £100.
14. Suspension and termination
You can stop using The AI Observer and delete your membership at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, if we are required to by law, or if we stop providing The AI Observer. If we end a paid membership for reasons other than your breach, we will refund any amount you have paid for the unused period.
15. Privacy and cookies
Our Privacy Policy explains how we use your personal data, and our Cookie Policy explains how we use cookies and similar technologies.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page with a new "Last updated" date and, where changes are significant, tell members by email before they take effect. If you continue to use The AI Observer after changes take effect, you accept the updated Terms.
17. General
If any part of these Terms is found to be unenforceable, the rest will remain in effect. If we do not enforce any of these Terms straight away, we may still do so later. You may not transfer your rights under these Terms without our consent. We may transfer our rights and obligations to another organisation, and we will tell you if this affects your rights. These Terms do not give anyone else any rights to enforce them.
18. Governing law
These Terms are governed by the laws of England and Wales. If you are a consumer, you may bring proceedings in the courts of England and Wales, or in the courts of the part of the UK or the country where you live, and you keep the benefit of any mandatory consumer protections in that country.
